Tigers’ Miguel Cabrera gets driver’s license back after FL DUI!

Another MLB player learning that DUI arrests are not perfect!

Miguel Cabrera’s driver’s license was reinstated when the DHSMV ruled Friday that the arresting officer did not have probable cause to believe that Cabrera was driving under the influence of alcohol.

The Detroit Tigers slugger’s license was initially suspended because he refused to take a breath test Feb. 16 as he was being arrested on a rural highway in Florida. Cabrera’s attorney, argued during an administrative hearing last Wednesday that Florida law states a driver has to be in control of an operable vehicle to be required to take a breath test.

Cabrera’s attorney also argued that although the St. Lucie County Sheriff’s deputies who arrested Cabrera saw him drinking scotch in his Land Rover that had broken down on State Road 70, they didn’t see him drive it there.

“While that may be in violation of a number of laws,” Cabrera’s attorney told the DHSMV, “it is not a violation of state DUI laws.”
