Understanding Florida DUI Diversion and First-Time Offender Programs

_DUI_Law

An arrest for DUI can be a daunting experience, especially for first-timers in the criminal justice system. Most people fear that one mistake can ruin their criminal history, work history, and overall reputation. The silver lining, however, lies in the fact that in some instances, there are chances to use a diversion and first-time offender program to resolve a DUI case without conviction, and it all begins by learning more about the process and whether you are eligible for the program.

What is a DUI diversion program?

DUI diversion programs are alternatives to traditional prosecution. Instead of moving forward with a conviction, eligible defendants may be allowed to complete specific requirements in exchange for reduced charges, or, in some cases, dismissal of their DUI entirely.

Florida does not have a single, statewide DUI diversion program. Instead, availability and rules vary by county and judicial circuit. Some programs are formal, while others are negotiated informally by experienced DUI defense attorneys.

Who can qualify?

Several factors are taken into consideration for eligibility. These include:

  • Whether or not this is your first DUI offense
  • Your blood alcohol content level
  • Whether or not there were any accidents or injuries
  • Whether or not there were any minors in the vehicle
  • Your criminal record

In general, those who are first-time offenders and have low blood alcohol content levels and no other factors working against them have the best chance of being eligible for diversion. Even in instances where eligibility is not apparent from the outset, alternatives may still be available.

What do these programs typically require?

While the requirements might differ, DUI diversion programs or first-offender programs usually include the following elements:

  • Completion of DUI school
  • Alcohol or substance abuse evaluation and treatment, if recommended
  • Community service hours
  • Payment of fines and program fees
  • Completion of a probationary period with no new offenses

While the benefits of these programs may be varied, by successfully completing the requirements, the charges against you may be reduced, withheld, or even dismissed, depending on the agreement.

Why legal representation matters

Diversion programs are not automatic, and you are not required to offer one by the prosecutor; nor will the court explain your options to you. A seasoned Florida DUI defense attorney will know the counties where diversion programs are available and how to effectively present your case.

Pleading guilty too early without the advice of a lawyer is a way to blow your chances at keeping a clean record.

Protecting your future after a DUI arrest

A DUI conviction can have far-reaching consequences beyond your driving privileges. It can also have an impact on your employment, professional licensing, insurance rates, and even future background checks. For first-time offenders, diversion programs can be an extremely powerful means of limiting or avoiding such long-term consequences.

If you or a loved one has been arrested for DUI in Florida, it is important to act fast. The sooner an attorney is retained, the more options you have.
