Beyond a reasonable doubt in a DUI case means that the state has proven their case beyond a reasonable doubt that your breath or blood alcohol level is above a 0.08 or beyond a reasonable doubt that your normal faculties are impaired. Beyond a reasonable doubt is the highest standard that there is under the law, and it’s reserved for criminal cases. It’s higher than any burden of proof in a civil case and a family law case. So the state has that burden to prove your guilt beyond a reasonable doubt in any DUI case.
