If you’re asked to take field sobriety tests in the state of Florida it’s up to you whether or not you want to participate in them or not. Field sobriety tests are not required in the state of Florida. You’re not required to do them, and field sobriety tests are designed to make you do things that you don’t normally do. People don’t normally have to balance on one leg. People don’t normally have to walk in a heel-to-toe fashion. They’re designed to make you uncomfortable, and it’s up to you to decide whether or not you want to do those or not. There’s many things that can affect someone’s performance on the field sobriety test whether it be nerves, whether it be being tired, and it’s up to you to decide how comfortable you are performing those. But you’re certainly under no obligation to do them.
