When Science Gets It Wrong: Blood Test Errors in Florida DUI Cases

Blood tests have a reputation for being the gold standard of DUI evidence. A number on a lab report feels objective, almost unimpeachable. But here’s a question worth asking: what happens between the needle and the number?

A lot, actually. Blood draws pass through several hands, several machines, and several chances for something to go sideways. For defense attorneys, that chain of custody is where the real story often begins.

How Blood Ends Up as “Evidence” in the First Place

When someone is suspected of DUI in Florida, officers may request a blood test, particularly if the person is unconscious, injured, or involved in a crash. That gap, sometimes just an hour or two, can matter enormously.

According to data published by the Florida Department of Highway Safety and Motor Vehicles, thousands of DUI arrests in Florida each year involve chemical testing of some kind, underscoring just how central these tests are to the state’s enforcement approach.

Lab error rates aren’t zero, either. Equipment requires regular maintenance and calibration, and technicians are still human. When attorneys request maintenance logs, technician certifications, and internal lab protocols, inconsistencies sometimes surface that were never mentioned in the original arrest report.
