It is completely up to you whether or not you want to take the breath test in the state of Florida or not. A breath test is conducted after you are under arrest, so you are under no obligation to take that test or not take that test. If you’ve been previously arrested for DUI and have refused a breath test, by refusing another breath test, the police can add another criminal charge against you for having previously refused a breath test.
