The difference between a misdemeanor and a felony DUI in the state of Florida, there’s 2 instances where there could be a difference. The first instance is when it comes to prior offenses. If you’ve been convicted twice in the past, of a DUI, there are instances where a third offense can be considered a felony DUI against you. Also, even if it’s a first DUI offense, if it involves serious bodily injury or death to another person, that also is considered a felony DUI offense in the state of Florida.
